Food-contact packaging must pass a PFAS test, not a supplier promise

Breaks listings In force 2026-08-12 EU

From 12 August the PFAS limits apply to any packaging that touches food. Above 50 ppm total fluorine the packager has to produce a fluorine-source statement, which means a lab result rather than a declaration.

What changed

Regulation (EU) 2025/40 sets three PFAS limits for food-contact packaging from 2026-08-12: any single non-polymeric PFAS below 25 ppb, the sum of targeted PFAS below 250 ppb, and all PFAS including polymers below 50 ppm expressed as total fluorine. Where total fluorine exceeds that threshold the manufacturer or importer must supply a statement on the fluorine source to the next operator in the chain. This is the one part of the PPWR first wave that cannot be satisfied by registering somewhere — it needs a test result per packaging material.

Who it catches

Anyone placing food or drink in packaging on the EU market — cups, trays, wrappers, pouches, seals, cutlery — including sellers who never touch the packaging themselves because a co-packer does.

What to do

Get the total-fluorine figure for every food-contact material from the packaging supplier in writing. If they cannot give a number, that is not a pass — it is an unverified material, and the statement obligation lands on you as the importer.
